HousesGate VOW Access Agreement

1. What this agreement is

1.1 This VOW Access Agreement (the Agreement) governs your access to listing data through the password-protected feature of the HousesGate website (the VOW). You must accept this Agreement before the VOW shows restricted listing information, including photos and prices. Accepting the Website Terms of Use alone does not open the VOW.

1.2 You accept this Agreement by opening it for review and selecting accept. We record that you accepted, the date, and the version you accepted. We send an email to the address you provided confirming that you agreed to this Agreement.

1.3 Accepting this Agreement does not impose any financial obligation on you and does not create a representation agreement between you and anyone.

1.4 Listing Data means real estate listing data, images, and related information supplied through the PropTx VOW Data Feed. PropTx means PropTx Innovations Inc. Member means Ali Tunio, Broker, the Member named in the PropTx VOW Datafeed Agreement dated March 18, 2026. Brokerage means HomeLife Landmark Realty Inc., Brokerage, with which Ali Tunio is registered under the Trust in Real Estate Services Act, 2002.

1.5 This version applies from the date it is published on the website and, where acceptance is required, when you accept it. Version: v6, October 5 2026.

2. Who is involved

2.1 The VOW is operated by Ali Tunio through HousesGate. Ali Tunio is Nabeel Irtaza Tunio, registered professionally as Ali Tunio. He is an individual and operates the website personally.

2.2 Listing Data comes from PropTx under its VOW Policy and Rules, which the website must follow. Where a PropTx rule governs display of its data, that rule applies to that data.

2.3 Ali Tunio personally owns and manages the website. Regulated real estate services are provided through HomeLife Landmark Realty Inc., Brokerage, under the applicable brokerage agreements. Personal website ownership does not exclude the Brokerage's advertising, supervision, VOW or other obligations under law or the applicable licensing arrangements.

3. Registration and credentials

3.1 You must provide your name and a valid email address. VOW access is allowed only after we verify the email address and record that you agreed to this Agreement.

3.2 You must use a username and password unique to you. One email address may be associated with only one username and password pair.

3.3 Do not share, sell, or divulge your credentials, and do not let anyone else access the VOW through your account. Tell us promptly about unauthorized use.

3.4 Passwords are valid for up to 90 days, after which they must be renewed or reconfirmed.

3.5 We keep a record of VOW registration and an audit trail of VOW access, and produce them to PropTx when its rules require. PropTx rules require the registration record to be kept for at least 180 days after your password expires. We do not keep your password in readable form.

4. Bona fide interest and personal use

4.1 You confirm that you have a genuine interest in the purchase, sale, or lease of real estate of the type offered through the VOW, and that you are not using the VOW for any commercial purpose or any other purpose.

4.2 All Listing Data obtained from the VOW is for your personal, non-commercial use only.

4.3 You will not copy, redistribute, or retransmit Listing Data, or otherwise use it, except in connection with your own consideration of the purchase, sale, or lease of an individual property.

5. Broker-consumer relationship

5.1 You acknowledge that, to access and use the VOW, you enter into a lawful broker-consumer relationship with Ali Tunio, the Member, who is registered with the Brokerage.

5.2 That relationship is limited to your use of the VOW. It is not a representation agreement and creates no financial obligation. This describes the effect of this Agreement only. It does not mean that no conduct, request, or separate document can ever create a brokerage relationship or duty, and it does not displace any duty real estate law or other applicable law imposes on Ali Tunio or the Brokerage.

5.3 If you ask for real estate brokerage services, the applicable representation documents and required disclosures, including the RECO Information Guide, apply before those services are provided. Anything actually done to provide brokerage services carries the duties that apply to it under real estate law.

6. Ownership and prohibited use

6.1 You acknowledge PropTx's ownership of, and the validity of PropTx's proprietary rights and copyright in, the MLS database, MLS data, the PropTx MLS system, and Listing Data.

6.2 You will not, directly or indirectly, display, post, disseminate, distribute, publish, broadcast, transfer, sell, or sublicense Listing Data to any other individual or entity.

6.3 Scraping, screen scraping, database scraping, data mining, and bulk collection are prohibited. So is any use of automated tools or other machine processing to collect, store, reorganize, summarize, extract patterns from, or manipulate Listing Data or related data. Ordinary browser functions and accessibility technology used simply to view Listing Data you are authorized to see, for your own consideration of an individual property, are allowed. They are not an exception to any other prohibited use in this section or in the PropTx rules.

6.4 You will not merge Listing Data with other data or use it to build any product or service.

7. Audit access

7.1 You expressly authorize PropTx, and other PropTx Members and their duly authorized representatives, to access the VOW to verify compliance with the MLS Rules and Policies, including the VOW Rules, and to monitor how Members' listings are displayed by the VOW.

8. Privacy

8.1 The VOW displays a privacy policy. Your personal information, including your name, email address, and telephone number if you give one, may be collected, used, and disclosed as described there, including that your personal information may be shared with PropTx for auditing or legal purposes. By accepting this Agreement, after the Privacy Policy and this section are shown to you, you give informed consent to the collection, use, and disclosure described there for the VOW, including the sharing with PropTx for auditing and legal purposes. This consent covers only what the Privacy Policy discloses for the services you request. It is not consent to marketing messages or to optional analytics, which are separate choices under the Privacy Policy.

9. Data limits and accuracy

9.1 The VOW does not provide full access to any MLS system. Search results and displayed data may be limited, and may not show every listing.

9.2 Listing Data is deemed reliable but is not guaranteed accurate. It may contain errors or omissions, may be out of date, and may be withdrawn. Verify independently before relying on it.

9.3 Some listings, or property addresses, are withheld from internet display at the seller's direction. We do not display them.

9.4 If you ask us to remove your personal information from the VOW, we comply as privacy law and board rules require, and we immediately advise PropTx and the listing brokerage so the affected listing can be set not to display and handled as their rules require.

9.5 Historical and archived Listing Data is subject to the same access and use restrictions as other Listing Data. Archived data is displayed only to the extent authorized by PropTx. We do not promise access to every historical record, a particular earliest year, or all details of an earlier listing. Historical information is not a statement that a property is currently available.

10. Prominent notice

10.1 The VOW prominently displays this notice:

The information provided herein must only be used by consumers that have a bona fide interest in the purchase, sale, or lease of real estate and may not be used for any commercial purpose or any other purpose. The information is deemed reliable but is not guaranteed accurate.

11. Suspension and re-acceptance

11.1 VOW access may be suspended, limited, or ended for breach of this Agreement, for security, to comply with PropTx rules, or on lawful direction. Obligations that accrued earlier survive.

11.2 If this Agreement is materially changed, you must accept the current version again before further VOW access.

12. Short acceptance notice

12.1 Before any Listing Data is shown, the VOW gate displays this short notice with a link to this Agreement. You must open this Agreement for review, confirm each statement below, and accept, before Listing Data is shown. We record your acceptance and the version you accepted.

I confirm that:

(a) I have that genuine interest, and I am not here for any commercial purpose;

(b) I will use the data only to consider individual properties, and will not copy, redistribute, scrape, or bulk-collect it except to consider an individual property;

(c) the data is deemed reliable but is not guaranteed accurate;

(d) I authorize PropTx and its members to access this site to verify compliance with their rules; and

(e) my name, email, and telephone number (if given) may be shared with PropTx for auditing or legal purposes.
