HousesGate Website User Agreement and Terms of Use
Operated by Nabeel Irtaza Tunio (Ali Tunio) as HousesGate
Version v6 · 2026-10-05
1. What these terms are
1.1 These Website Terms of Use (the Terms) are between you and Ali Tunio, who operates the website as HousesGate (the Operator). They govern your access to and use of the HousesGate website and its features (the website).
1.2 Ali Tunio is a Broker with HomeLife Landmark Realty Inc., Brokerage. HousesGate is the website and business name of Nabeel Irtaza Tunio, registered professionally as Ali Tunio. HousesGate is not a corporation and is not a separately registered real estate brokerage. Ali Tunio provides regulated real estate services only through the Brokerage. Operator and contact details are in the Operator and Business Details schedule (/business-details).
1.3 Three documents are separate from these Terms: the VOW Access Agreement (/vow-agreement), which you must accept before restricted listing data is shown; the Privacy Policy (/privacy); and the Buyer Cashback Terms (/cashback-terms), which you accept only when you accept a cashback offer. Each governs its own subject. These Terms govern the website generally.
1.4 This version applies from the date it is published on the website and, where acceptance is required, when you accept it. Version: v6, October 5 2026.
2. Definitions
Listing Data means real estate listing data, images, and related information made available through the website under the rules of PropTx.
VOW means the password-protected listing-data feature governed by the VOW Access Agreement.
PropTx means PropTx Innovations Inc.
Brokerage means HomeLife Landmark Realty Inc., Brokerage.
Account means a registered account on the website.
Content means all material on or through the website, including Listing Data, text, images, and design, except your User Content.
User Content means content you submit through the website, such as saved searches, notes, and inquiries.
3. Acceptance
3.1 You agree to these Terms when they are presented to you conspicuously and you accept them, for example with a click-to-accept control. Electronic acceptance can have the same effect as a signature under the Electronic Commerce Act, 2000, but only where the presentation, your capacity to agree, and our acceptance records actually support it. Accepting these Terms is not consent to any collection, use, or disclosure of personal information, to optional cookies, or to marketing messages. The Privacy Policy is a separate notice with its own choices, which you make separately.
3.2 If you do not agree, do not use the website.
4. Accounts
4.1 Accounts are for individuals who are at least 18 years old and who use them for personal purposes.
4.2 You must give accurate, current information when you register and keep it up to date.
4.3 Your login credentials are personal. One email address may have only one username and password pair. Do not share your credentials or let anyone else use your Account. Tell us promptly about any unauthorized use or suspected compromise. You are responsible for activity under your Account only to the extent it results from use you authorized or from not taking reasonable steps within your control, such as keeping your password private or reporting a compromise you knew about. Nothing in this section waives a right or defence you have under applicable law.
4.4 For VOW access, passwords are valid for up to 90 days and must then be renewed or reconfirmed. The VOW Access Agreement sets out those rules.
4.5 We may refuse registration, or suspend, limit or end an Account, as section 12 explains.
5. Acceptable use
5.1 You may use the website only for lawful, personal purposes.
5.2 You must not, and must not help anyone else:
(a) copy, scrape, harvest, or redistribute Content or Listing Data, except for your own consideration of an individual property through the VOW;
(b) use automated tools, robots, scrapers, or any other machine processing to access, monitor, extract, collect, summarize, or manipulate the website, its Content, or Listing Data, except as the website itself provides to you. Ordinary browser functions and accessibility technology used simply to view or read pages for your own personal use are allowed. They are not an exception to the limits on copying, extracting, or reusing Listing Data or Content, including the narrower VOW restrictions in the VOW Access Agreement;
(c) interfere with the website's security features or impose an unreasonable load on it;
(d) misrepresent who you are, your affiliation, or your genuine interest in a real estate transaction; or
(e) submit government identifiers, payment card or bank account numbers or credentials, or health records through ordinary website forms, or submit other sensitive documents the website does not need. Information a service specifically asks you to provide, such as a property choice, a showing or appointment request, a budget, or a proposed purchase price, is not banned by this paragraph and is handled under the Privacy Policy;
5.3 Some of these rules protect obligations the website owes to PropTx. Following them is a condition of your licence to use the website.
6. Intellectual property
6.1 The website and Content are owned by or licensed to the Operator and protected by law. Listing Data is proprietary to PropTx and its licensors under the PropTx agreements.
6.2 We give you a limited, revocable, personal, non-commercial licence to access the website and view Content. You may print or save individual pages for your own use if you keep notices intact. Where the VOW Access Agreement sets narrower limits for Listing Data, including use only to consider an individual property, those narrower limits govern. Nothing in this section licenses copying or storing Listing Data in bulk. The licence ends if you breach these Terms.
6.3 MLS, Multiple Listing Service, and REALTOR are marks owned and controlled by The Canadian Real Estate Association (CREA). PropTx holds separate proprietary rights, including database and copyright rights, in its MLS database, MLS data, and the Listing Data supplied through its system. Other boards and licensors may hold further related rights. Nothing here licenses any of these marks or rights to you.
7. Your content
7.1 You keep ownership of your User Content.
7.2 You grant the Operator a limited licence to host, store, reproduce, and use your User Content only to provide and secure the services you request and to comply with law and PropTx rules. Nothing else.
7.3 You are responsible for your User Content, which must be lawful and must not violate anyone's rights. We may remove or refuse content to comply with law, respond to lawful requests, or enforce these Terms.
8. Property information
8.1 Figures shown on the website, including prices, historical figures, and any estimate, are indicative market information for general information only. They are not appraisals, not guarantees, and not individualized advice about any property.
8.2 Records behind these figures can be missing or out of date, including actual or effective age, renovations, condition, and local comparable information. Market conditions change. Verify anything you rely on, with qualified professionals where appropriate.
8.3 Short notice: Property figures are indicative market information, not an appraisal or advice. Point-of-use notices accompany the full Terms.
9. No brokerage services by accepting these Terms
9.1 Accepting these Terms does not create a representation agreement or agency relationship, does not promise any brokerage service, and does not create any financial obligation. This describes the effect of these Terms only. It does not mean that no conduct, request, or separate document can ever create a brokerage relationship or duty, and it does not displace any duty real estate law or other applicable law imposes on Ali Tunio or the Brokerage.
9.2 If you request real estate brokerage services, the applicable representation documents and required disclosures, including the RECO Information Guide, apply before those services are provided. Those records are separate from these Terms. Anything actually done to provide brokerage services carries the duties that apply to it under real estate law.
9.3 Requests for real estate assistance made through HousesGate are received by Ali Tunio. If another agent is proposed to assist or receive a referral, we identify that agent and brokerage and obtain your informed permission before sharing your contact details and request. Any referral or cooperation fee is arranged through the applicable brokerage or brokerages. It does not become a fee you owe merely by using this website. Any financial benefit or conflict disclosure required by law is given separately, at the required time.
9.4 You remain free to choose whether to accept an introduction and whom to engage, subject to any separate representation agreement you have entered. A referral arrangement between agents does not transfer your representation or authorize someone to act for you. Sending an online offer request does not itself submit, sign or accept an agreement of purchase and sale. A showing request is not a confirmed appointment until confirmation is communicated.
10. Disclaimers and your rights
10.1 The website and Content are provided on an as is and as available basis, without warranties except as expressly stated.
10.2 Listing Data is deemed reliable but is not guaranteed accurate.
10.3 Nothing in these Terms limits or excludes any right you have under applicable law that cannot lawfully be limited or excluded, including under the Consumer Protection Act, 2002 where it applies. Nothing here waives responsibility for deceptive or misleading claims.
11. Liability
11.1 To the extent permitted by law, the Operator is not liable for indirect, incidental, or unforeseeable losses, or for lost profits, arising from your use of the website. This does not apply to fraud or wilful misconduct, to responsibility for your personal information, to brokerage obligations, to earned cashback payment obligations, or to any liability that cannot lawfully be excluded.
11.2 These Terms set no dollar cap and waive no mandatory consumer remedy.
12. Suspension, termination, and changes
12.1 You may stop using the website at any time and may ask us to delete your Account, subject to records we must keep under the Privacy Policy and the VOW Access Agreement.
12.2 We may suspend, limit, or end access for breach of these Terms, for security, to comply with PropTx rules, or on lawful direction. Where practicable we give notice first. Rights and obligations that accrued before suspension or termination survive.
12.3 For changes that materially and adversely affect you in the ordinary course, we give at least 30 days notice before they take effect. Urgent changes needed for law, security, or PropTx compliance take effect when posted and are explained promptly. Changes do not apply retrospectively to your prejudice.
12.4 If a change materially affects the VOW Access Agreement, you must accept the current version again before further VOW access.
13. Governing law and disputes
13.1 These Terms are governed by the laws of Ontario and the federal laws of Canada that apply in Ontario.
13.2 The courts of Ontario have jurisdiction over disputes, and you may bring a claim in Small Claims Court where it has jurisdiction. Nothing in these Terms requires arbitration, waives class proceedings, or shortens any limitation period that applies to you.
14. Transfer of the website
14.1 You may not transfer these Terms to anyone else.
14.2 If the website is ever transferred to a new operator, we give you notice, and listing-data feed rights and brokerage relationships do not transfer automatically. Any transfer happens only with the consents required for it, and your personal information is handled as the Privacy Policy says.
15. General
15.1 If a provision is unenforceable, the rest continues.
15.2 We give notice by posting on the website or emailing your Account address. You may contact us using the details in the Operator and Business Details schedule.
15.3 These Terms, the documents you separately accept, and the schedules are the entire agreement about the website. A brokerage representation agreement you sign with a brokerage governs the services it covers and is not replaced by these Terms.
15.4 Sections that should continue after termination do so.
