How We Keep It Above Board
Buyer cashback is legal in Ontario when it’s done properly. Here’s what “properly” means.
It’s in Your Agreement
Your cashback, and how we work it out, is written into your Buyer Representation Agreement before you buy. Nothing rests on a verbal promise.
Your Lender Knows About It
We tell your mortgage lender about the rebate. Some lenders cap it or limit how it can be used, so we check with yours before closing.
Tax Depends on the Home
If it’s a home you’ll live in, cashback generally isn’t treated as taxable income. An investment property is handled differently, and how HST applies to rebates isn’t settled yet, so your accountant can tell you what applies to you.
Not a Bird-Dog Fee
Paying an unregistered third party to connect you with a real estate deal, a “bird-dog” fee, isn’t allowed in Ontario. We don’t do it. Your cashback is a rebate paid directly to you, the buyer and our client.

Frequently Asked Questions (FAQ)
When do I actually get the money?
After your purchase closes, once the commission for your purchase has come in. The Cashback Terms set out the timing.
Does cashback change my offer price?
No. Your offer price stays the same. The cashback is handled separately and paid to you after closing.
What if the listing doesn’t offer a buyer commission?
Then there’s nothing to share, so there’s no cashback on that home. This mostly happens with private sales and some builders. We’ll tell you before you make an offer.
Can I get cashback if I already have an agent?
Usually not for that purchase. Cashback depends on us representing you, set up before the purchase starts.
Do I have to pay tax on it?
For a home you’ll live in, cashback is generally not treated as taxable income. Investment properties are different. Tax rules can change and every situation is different, so check with your accountant.
Can I use it for my down payment?
No. It’s paid after your purchase closes, so it can’t go toward your down payment. Once it arrives, it’s yours to use as you like.
Unlock Your Homebuyer Cashback
Sign up, book your first showing, and we’ll put your cashback in writing before you make an offer.
Estimates only. Cashback is up to 1% of the sale price, paid from the buyer-side commission on the home you buy, after your purchase closes. The amount, eligibility and timing are confirmed in writing in your Buyer Representation Agreement and depend on the commission offered, your lender’s rules and the details of your purchase. Nothing on this page is legal, tax or financial advice. Terms and conditions apply. Read the full Cashback Terms.
Cashback moves with the commission. A listing that offers a lower buyer commission gives a smaller cashback, and private sales (FSBO) or builders that offer no buyer commission give none. Cashback doesn’t apply to a purchase where you’re represented by another agent, and it must be written into your Buyer Representation Agreement before you make an offer.
Lenders set their own rules. Some cap a rebate or limit how it’s used. We confirm what your lender allows before closing.
